The management of the institution had no doubt whether Janša should be enabled to participate at the session, said Jože Podržaj, the Acting Director of Board for enforcement of penal sanctions. The only question was in which manner.
A gathering has been announced in front of the National Assembly, which meant additional assessment of eventual safety risks had to be made. The situation is specific, he claims, and deviates from any practice within the prison system so far. And it has nothing to do with the convict.
Janša will leave the prison alone
Thus Janša will exit the prison alone, with an adequate permit, on which the time of departure and the estimated time of arrival, which would be quite impossible to define precisely due to the nature of work. "The time of arrival is always estimated with a reserve; he can come back earlier, while the deadline is written on the permit,"he explained. It is the usual procedure for other convicts as well.

The Acting Director of the Institute explained that the lawyers helped with interpretation of the Article 50 of the Act on Execution of Penal Sanctions, which in their opinion does not cover this specific situation. "There is no provision in the act which would prevent participation at sessions,"said Podržaj. The mentioned article speaks of assignments to jobs made by the institute, which is not the case here. "Janša was elected to this job, and therefore the mentioned provision can't apply," he explains.
A new procedure for every session
Podržaj emphasized that they would wait for the mandate-elective commission to confirm the mandate of Janša, and only then make decisions regarding Janša's exits for other sessions. If his mandate is confirmed, Janša will have to express intent for his participation at a session each separate time, and thus initiate the formal procedure. Before having served one fifth of his sentence, Janša has two more options at his disposal: the director of the institution can, at Janša's request, temporarily suspend his sentence, or the court, at Janša's, initiative can decide on his serving the sentence during weekends.
